These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and FactoruM Community CIC (“Company”, “we”, “us”, "Factorum Community", "The CIC", "Factorum CIC" or “our”), concerning your access to and use of the www.factorum-community.org website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). By accessing the Site, you agree to be bound by these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. It is your responsibility to periodically review these Terms to stay informed of updates.

Unless otherwise indicated, the Site and all content and other materials therein, including, without limitation, the Factorum Community CIC Logo, and all designs, text, graphics, pictures, information, data, software, sound files, other files, and the selection and arrangement thereof are the proprietary property of FactoruM Community CIC, Factorum Ltd. or our affiliates, licensors, or users, as applicable.

You are granted a limited, non-exclusive, non-transferable, and non-sublicensable license to access and use the Site and the content for your personal, non-commercial use only. Any other use of the Site or content is strictly prohibited without our express prior written consent.

By using the Site, you represent and warrant that:

2. You will maintain the accuracy of such information.

3. You have the legal capacity and agree to comply with these Terms of Use.

4. You are not a minor in the jurisdiction in which you reside.

6. You will not use the Site for any illegal or unauthorised purpose.

7. Your use of the Site will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).

You may be required to register with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

At FactoruM Community we provide a venue for people to interact and engage with others as well as events and services. These services include our venues tables, terrain and space. These can be provided through memberships or through day rate payments. The venue reserves the right to decline any access of any persons.

All memberships provided are on a person by person basis and are non-transferable. Another person may not use your membership. The venue is available for use during its opening hours unless with prior consent from a director.

Events may be provided by FactoruM Community CIC or by third parties, in the case of third parties please be aware of their terms and conditions.

We are committed to providing you with a variety of payment options for your convenience. Accordingly, we accept the following payment methods:

When making a purchase on our Site, it is essential that you provide current, accurate, and complete purchase and account information. This includes the obligation to promptly update your account and payment details, such as email address, preferred payment method, and credit card expiration date, to ensure we can process your transactions efficiently and maintain communication as needed. Sales tax will be added to your purchases if applicable, according to our policies. Be aware that we reserve the right to modify prices at any moment without prior notification. All transactions will be processed in Pound Sterling (GBP). Please be aware that choosing a payment method or currency conversion may be subject to additional fees by your card issuer or payment service provider that are not within our control.

By completing a purchase, you agree to pay all charges at the prices in effect at the time of your order, in addition to any applicable shipping fees. You grant us the authorization to charge your chosen payment provider for these amounts upon placing your order. Should any pricing errors or discrepancies occur, we reserve the right to correct these, even if payment has already been requested or received.

We also hold the right to decline any order submitted through the Site. In our sole discretion, we may limit or cancel quantities purchased per individual, per household, or per order. These restrictions may apply to orders placed under the same customer account, orders that utilise identical payment methods, and/or orders that are billed or shipped to the same address. We specifically reserve the right to limit or prohibit orders that, according to our judgment, seem to be placed by dealers, resellers, or distributors.

Memberships may be cancelled and refunded within 24 hours of purchase, although you have a right to cancel at any time.

Event tickets may be cancelled at any time but are only able to be refunded if cancelled more than 7 working days before the event in question.

The Site is provided for specific, approved uses only, and you are prohibited from using it for any purposes beyond those expressly permitted by us, especially commercial activities not explicitly sanctioned by us.

As a Site user, you are prohibited from engaging in the following activities:

1. Collect Site content or data without our written permission.

2. Mislead or attempt to extract sensitive information like passwords.

3. Interfere with the Site's security measures.

4. Harm our or the Site's reputation.

5. Use Site information to harass or harm others.

6. Abuse our support services or submit false complaints.

We hold the exclusive right, at our own discretion and without any obligation to notify or bear liability, to restrict or revoke access to our Site and its services (this includes blocking specific IP addresses) for any individual, at any time and for any reason. This includes reasons such as violations of any terms, warranties, or legal regulations outlined in our Terms of Use. We may also terminate your access to our services, delete your account, and remove any content you have posted on our Site, at our discretion and without prior notice.

Should your account be terminated or suspended for any reason, you are immediately barred from creating a new account under your own name, or any other name—real, assumed, or borrowed. This measure extends to attempting to register on behalf of someone else. Following the suspension or termination of your account, BUNKER Miniatures reserves the right to pursue any necessary legal actions, including but not limited to civil, criminal, and injunctive measures, to uphold the terms and protect the integrity of our Site.

FactoruM Community CIC reserves the unrestricted right to alter, adjust, or eliminate any part of our Site's content whenever necessary, at our complete discretion, without prior notification. There is no commitment on our part to maintain current information on our Site. Furthermore, we hold the authority to modify or cease any or all services offered through the Marketplace at any given time without prior notice. We are not accountable to you or any third party for any changes, pricing adjustments, suspensions, or discontinuation of our Site or services.

The continuous availability of our Site and Marketplace Offerings cannot be assured. Possible technical issues, maintenance requirements, or other factors may cause temporary interruptions, delays, or inaccuracies in service. We retain the right to amend, pause, or discontinue the Site or Marketplace Offerings for any reason, at any time, without notifying you. FactoruM Community CIC bears no responsibility for any potential inconvenience, loss, or damage resulting from any interruption or cessation of access to our Site or services. These Terms do not bind us to maintain, support, update, or provide any corrections to our Site or services.

The terms and conditions outlined herein are subject to and shall be interpreted in accordance with the laws of the United Kingdom, explicitly excluding the application of the United Nations Convention on Contracts for the International Sale of Goods. For individuals residing in the EU and identified as consumers, you are granted additional protections under the mandatory legal provisions of your country of residence. FactoruM Community CIC and you agree to the non-exclusive jurisdiction, allowing for the possibility of upholding your consumer protection rights concerning these Terms of Use either in the United Kingdom or in the EU country where you reside.

It's possible that the Site may include typographical mistakes, inaccuracies, or missing details related to our Marketplace Offerings, such as product descriptions, pricing, availability, and more. FactoruM Community CIC will store specific data you send to our Site to enhance site performance, generate sales material (including newsletters) and monitor your usage activities. Despite conducting regular data backups, the responsibility for any data you upload or actions taken on the Site rests entirely with you. We are not liable for any delays or failures in performance resulting from circumstances beyond our reasonable control. Should any part of these Terms be deemed illegal, void, or unenforceable, that section shall be severable, not affecting the validity and enforceability of the remaining parts. No joint venture, partnership, employment, or agency relationship exists between you and FactoruM Community CIC due to these Terms or your use of the Site. These Terms will not be interpreted against us despite our role in drafting them. By agreeing to these Terms, you forfeit any defence you might have regarding their electronic format or the electronic execution of these agreements.
